Prohibited AI Practices: What's Banned Now
As of February 2, 2025, specific AI practices are strictly prohibited under the EU AI Act. Businesses must ensure their systems do not engage in these activities to avoid severe penalties.
Manipulative Techniques
AI systems employing subliminal techniques or exploiting vulnerabilities of specific groups (e.g., age, disability) to cause harm are banned. This includes patterns that distort user behavior.
Mass Surveillance & Scoring
Social scoring by public authorities and real-time remote biometric identification in public spaces are prohibited, except for very limited, specific exceptions like searching for crime victims.
Sensitive Data Inference
AI that infers emotions in workplace/education, biometric categorization systems, and those inferring sensitive personal data (e.g., political opinions, sexual orientation) are strictly forbidden.
AI Literacy: A Mandatory Skillset
As of February 2, 2025, the EU AI Act mandates that both providers and deployers ensure their staff possess sufficient AI literacy. This involves developing the skills, knowledge, and understanding necessary to deploy AI systems safely and ethically, while also identifying opportunities, risks, and potential harms.
Core Understanding
Equip staff with fundamental knowledge of AI principles, capabilities, and ethical considerations for responsible deployment.
Risk & Harm Awareness
Foster an understanding of potential biases, privacy issues, and the broader societal impacts of AI systems to mitigate risks.
Training Programs

General Purpose AI (GPAI) Model Requirements: Key Obligations
Effective August 2, 2025, the EU AI Act introduces specific requirements for General Purpose AI (GPAI) models, including foundation models and generative AI systems. These obligations aim to ensure responsible development and deployment.
Transparency Obligations
Providers must be transparent about the capabilities, limitations, and the data used for training GPAI models.
Robust Risk Management
Implement comprehensive processes to identify, evaluate, and mitigate risks associated with GPAI models throughout their lifecycle.
Technical Documentation
Maintain detailed documentation on the model's design, training methodology, performance, and risk management systems.
Systemic Risk Evaluation
GPAI models with significant computational power (over 10^25 FLOPs) require additional evaluation for potential systemic risks.
Code of Practice Compliance
Adhere to codes of practice on responsible AI development, covering aspects like cybersecurity and environmental sustainability.
The European Commission is actively developing specific guidelines and codes of practice to support compliance with these evolving requirements.
Risks for Businesses
€35M
Fines
The EU AI Act imposes stringent penalties for non-compliance. These include fines of up to €35 million or 7% of global annual turnover for the most serious violations (prohibited AI practices), €15 million or 3% for other violations, and €7.5 million or 1.5% for providing incorrect information.
75%
Reputation
Failure to comply with the EU AI Act can erode public trust and brand reputation, potentially leading to customer churn and decreased market share.
10%
Liability
Organizations using AI systems that do not meet the EU AI Act's requirements could face legal challenges and substantial financial liabilities if their systems cause harm or infringe on individual rights.
The EU AI Act emphasizes transparency and accountability, mandating clear documentation and reporting on AI systems, and requiring proactive risk assessments.
